ما زال مشروع قانون الأحوال الشخصية الجديد يثير جدلًا كبيرًا بين أمهات مصر الحاضنات، حيث تلقت جمعية نهوض وتنمية المرأة مئات الآلاف من استغاثات الأمهات الحاضنات المصريات وأطفالهن بعد أن تم الاعلان عن الانتهاء من صياغة مواد مشروع قانون الأحوال الشخصية مطالبين بتوصيل أصواتهن لرئيس الجمهورية وصناع القرار، حيث انقسمت الآراء ما بين القبول والرفض للتعديلات، إلى جانب مطالبات من البعض بتعديل قوانين غير مطروحة على أجندة المقترح.
ومن أهم البنود التي استعرضها مقترح القانون الجديد هى “الولاية على النفس والولاية على المال والإجراءات المنظمة للمسائل الشخصية.
ونحن في جمعية نهوض وتنمية المرأة نرفض المطالبة بأية تعديلات للقوانين المخالفة للشريعة وغير منصفة للمرأة والطفل.
ونؤكد أن بعض من بنود القانون الجديد يسهم في حل النزاعات الأسرية ومعالجة العديد من المشكلات التي كانت عالقة لسنوات، ولكن هناك بعض من البنود التي نرفضها تمامًا، حيث ان بها ظلم واضح للمرأة المصرية وطفلها، فالقانون الحالي للأحوال الشخصية تم مراجعته أكثر من مرة وتم عرضه على الأزهر الشريف ومجمع البحوث الإسلامية عدة مرات وذلك بتشكيل لجنة فقهية لدراسة كافة مواد القانون بما يتوافق مع الشريعة الإسلامية تحت رئاسة الدكتور/ أحمد الطيب – شيخ الأزهر، وكانت القرارات النهائية نابعة من الشريعة الإسلامية ولا تخالفها ويتم استمرار العمل بها دون تغيير.
وفي إطار الدراسات التي قامت بها جمعية نهوض وتنمية المرأة نرد على هذه التعديلات:
• أولًا: نجد أن التأكيد على إقرار بند الاستضافة وتغيير مسماه إلى مصطلح الاستزاره، مرفوض رفضًا قاطعًا، حيث أن الرأي الشرعي يشير إلى أن القانون الحالي يتبع الشرعية الإسلامية، وكانت القرارات النهائية بأنه يجوز للطرف غير الحاضن استضافة الصغير بشرط أخذ إذن الحاضن ورأي المحضون.
– كما عرضت فتوى الأزهر الشريف رقم740 وقرار مجمع البحوث الإسلامية في سبتمبر 2007 بأن الزوجة ليست بملزمة شرعاً بإرسال الطفل إلى أبيه لرؤيته في مكان إقامته ولا استضافته في العطلات الأسبوعية أو الرسمية ولا أخذه منها للتصييف معه مادام في حضانتها وإنما يمكن ذلك بالتراضي بين الطرفين.
– كما أن القوانين المقترحة بالزام الاستزارة بدلًا من الرؤية لم تتطرق لمخاطر الاستضافة والتي نجد أن هناك الآلاف من قضايا الخطف التي لم تستطع الأم إسترداد طفلها مرة أخرى ، هذا إلى جانب عدم تحديد آلية متابعة عملية تسلم وتسليم الأطفال، وإرجاعهم مرة أخرى للطرف الحاضن حتى لو أقر مقترح القانون بالعقوبة المشددة لمن يقوم بعدم إرجاع الطفل.
• ثانيًا: بالنسبة للبند الخاص بتعديل ترتيب الحضانة ففيه مخالفة للشريعة الإسلامية، حيث أقر مجمع البحوث الإسلامية في مايو 2011 بتشكيل لجنة فقهية لدراسة كافة مواد قانون الأحوال الشخصية ومن ضمنها بند ترتيب الحضانة بما يتوافق مع الشريعة الإسلامية، برئاسة الدكتور /أحمد الطيب- شيخ الأزهر وأقرت اللجنة باستمرار العمل بترتيب الحضانة للأم ثم والدة الأم ثم والدة الأب ثم أخواتها، وليس نقل الحضانة مباشرة من الأم للأب لأن النساء أقدر على تلبية احتياجات الطفل، فلماذا يتم تغيير قانون حالي نابع من الشريعة الإسلامية والتي هي مصدر قانون الأحوال الشخصية، ونرى أن هذا البند يحتاج إلى مزيد من النقاش، فالأولوية يجب أن تكون للمصلحة الفضلى للطفل، خاصة في مراحله العمرية المبكرة، حيث يكون بحاجة إلى الرعاية والعناية داخل بيئة أسرية مستقرة .
كما أن المطالبة بتعديل سن الحضانة المنتشرة على صفحات التواصل الاجتماعي ليكون 7 سنوات للولد و9 سنوات للبنت، بحيث ينتقل الطفل لحضانة للأب بعد ذلك، مرفوض تمامًا ومخالف للقانون الحالي الذي ينص على أن الحضانة تكون للولد حتى سن 15 سنة وللبنت حتى سن الزواج، على أن يُخير الطفل بين الأب أو الأم أمام المحكمة . وبالنسبة لأقوال البعض بأن الأطفال مع دخولهم مرحلة المراهقة يكونوا في احتياج أكثر للوالد لتقويمهم، وغير ذلك من الحجج، فإن من المعلوم أنه وفقاً للاتفاقيات الدولية –التي صدقت عليها مصر ووقعت عليها- فإن سن الطفولة يمتد حتى الثامنة عشر. فوفقاً لتعريف اتفاقية حقوق الطفل فإن الطفل هو: “كل إنسان لم يتجاوز الثامنة عشر ما لم يبلغ سن الرشد قبل ذلك بموجب القانون المنطبق عليه”، لذلك نرفض تماما المساس بهذا القانون.
كما أشارت جمعية نهوض وتنمية المرأة على أن هناك العديد من الايجابيات في المقترح الذي تم التصريح عنه من أهمها :
• بخصوص البند الذي ذكر فيه” إذا توفى الأب تكون الأم هي الوصية على أطفالها قبل الجد”، فنؤكد أن هذا القانون يعتير خطوة جيدة على الطريق الصحيح لحل العديد من المشكلات التي تواجه بعض من الأمهات حيث كان القانون الحالي ينص على أن الوصي على إدارة أموال القصر الذين لم يبلغوا سنهم القانونية بعد وفاة الأب، هو الجد للأب.
• بالاضافة إلى اصدار بند يوجب وقوع الطلاق الشفوي وبذلك يحد من تلاعب العديد من الأزواج بزوجاتهم ووقوع الزوجات في مشاكل عديدة للحصول على الطلاق الرسمي أو اثبات الطلاق.
هذا إلى جانب منح صلاحيات جديدة للقاضي للتعامل مع الحالات العاجلة من أجل دعم الأسرة، بالاضافة إلى وضع نظام جديد يجمع منازعات كل أسرة أمام محكمة واحدة، وتقصير مدد الفصل فى دعاوي الأسرة، هذا إلى جانب وضع البنود المتعلقة بالخطوبة والعدول عنها ورد الشبكة .
في النهاية تشدد جمعية نهوض وتنمية المرأة على ضرورة إجراء حوار مجتمعي حقيقي حول مشروع قانون الأحوال الشخصية يضم جميع الأطراف المعنية وأن يُؤخذ برأيهم في التشريع الجديد والانطلاق من مصلحة الطفل ثم الموازنة في الحقوق والواجبات بين باقي الأطراف.
وتشدد على ضرورة دراسة الوقائع العملية لمسائل الأحوال الشخصية وظروف المجتمع لمراعاة إصدار قانون قابل للتطبيق يحقق المصلحة الفضلى للطفل بدلًا من أن يزيد أزماته.
